Helena Rubinstein and L'Oréal lose Botox trademark legislation case
ECJ rules against beauty giant
The European Court of Justice (ECJ) has scrapped trademark registrations for Botolist by Helena Rubinstein and Botocyl by L’Oréal, because they would trade partly on the reputation of Allergan Inc’s established trademark Botox.
The two companies were appealing against a trademark annulment by European Union trademark regulator the Office for Harmonisation in the Internal Market (Trade Marks and Designs).
