The Modernisation of Cosmetic Regulations Act of 2022 (MoCRA) is the first major update to the US Food and Drug Administration’s (FDA) authority over cosmetic products since 1938 – and is transforming the industry with new rules that are effective from 29th December 2023. Any brand distributing into the US, including British and European businesses exporting to the territory, must ensure that their practices comply with the new law to maintain access to this $430 billion market1.
While the industry waits for the FDA to finalise instructions and guidance, MSL Solution Providers (MSL), the UK’s leading regulatory and microbiological testing house, is urging companies to take action now so they’re ready for the changes that MoCRA will bring. The four key areas that brands exporting to the US need to consider relate to mandatory facility registration, product listing, adverse event reporting, and safety substantiation.
With its extensive experience in working with US cosmetics and personal care product manufacturers, MSL can help businesses ensure that they stay compliant when the law comes into force. Their services include acting as US agent, facility registrations, product listings, FDA and state regulatory compliance checks on formulations, safety substantiation, accelerated stability studies, and preservative efficacy (challenge) testing.
Alex Fotheringham, Operations Director at MSL Solution Providers, comments, ‘We know that many brands and companies are still waiting for the FDA to issue their final instructions, however, our advice is not to delay any further. The new rules will come into force as of 29th December, so with only a few months to go, they must act now to continue selling in the US. We are committed to helping cosmetics companies get set for business once MoCRA comes into effect.’
