French sanctions for sale price fixing agreements reinstated

Supreme Court overturns annulment


Sanctions imposed in 2006 on major French cosmetics and perfumes companies and distributors for what were alleged at the time to be sale price fixing agreements are to be reinstated, following a ruling by the Supreme Court.

The court has reversed the ruling delivered in 2009 by the Court of Appeal in Paris which had earlier annulled the sanctions. The country's competition authority (CdC) in 2006 imposed fines totalling €42.6m on 13 major cosmetics and perfume producers and three distributors, including subsidiaries of L'Oréal, Chanel, Hermes and LVMH.
