ECJ backs Oystra over Oyster Cosmetics

Italian brand fails to secutre EU-wide trademark


The general Court of the European Court of Justice (ECJ) has ruled that Italy’s Oyster Cosmetics cannot secure EU-wide trademark rights to its Oyster Cosmetics brand. The court backed has German rival Kadabell’s opposition because of potential confusion with its established Oystra cosmetics brand. The court said English speakers “might find those marks conceptually similar”.
