P&G challenges cosmetic lookalikes

Texas-based Fruit of the Earth is feeling the wrath of Procter & Gamble after the C&T giant filed a lawsuit against it, alleging infringement of three patents plus infringement of the Olay Regenerist brand packaging. Meanwhile in Ohio P&G has filed a lawsuit against California’s Blue Cross Laboratories for infringing P&G’s packaging for Herbal Essences. “The unauthorised use of P&G’s trade dress is likely to cause confusion and could jeopardise the goodwill established among consumers,” says Jim Johnson, P&G chief legal officer.
